Moments is a curated travel discovery and planning platform.

Moments helps users discover curated collections, stays, spots, optional activities, shared trip lobbies and hosted retreat concepts shaped by independent curators and third-party providers.

Moments provides software, content, curation, planning tools, trip organization features and booking access points.

Moments does not collect traveler payments for hotel stays or activities and does not act as the merchant of record for those services.

Hotel booking and payment flows are processed by the Hotel Booking Partner. Activity booking and payment flows are processed directly by the relevant local provider, DMC, guide, activity partner or payment link provider, such as InTravel where applicable.

In these Terms, “Hotel Booking Partner” means Nuitée Travel Limited and its LiteAPI booking and payment infrastructure, together with its relevant booking, payment, accommodation and supplier partners where applicable. “Activity Provider” means an independent local provider, DMC, guide, activity partner or payment link provider (including InTravel where applicable) through which an activity is booked, operated or paid for.

Moments is not a traditional travel agency, package tour operator, hotel operator, activity operator, guide company, transportation provider or destination management company.

Moments does not own, operate, control or deliver hotels, accommodation, guided tours, activities, transfers, meals, transportation, destination services or local services unless expressly stated in writing for a specific service.

Moments does not sell package tours, all-inclusive travel products or bundled travel services under one total package price.

A Moments collection is a curated point of view and planning layer. It is not, by itself, a package tour, package holiday, all-inclusive trip, guaranteed travel arrangement or confirmed reservation.

Stays, activities and other travel services displayed or linked on the Platform may be provided by independent third-party providers, including hotels, accommodation suppliers, the Hotel Booking Partner, its booking/payment partners, DMCs, local activity providers, guides, transportation providers, restaurants, venues or other service providers (“Providers”).

When you book a stay, activity or other service, you may enter into a separate contract with the relevant Provider. That Provider is responsible for the service it provides.

Moments may display information, organize travel context, connect you to a booking flow, redirect you to a Provider payment link, or provide product-level support. This does not make Moments the provider, seller, merchant of record, payment collector or operator of the underlying travel service.

Hotel bookings displayed on Moments are processed through the Hotel Booking Partner.

When you book a hotel stay, the payment is processed by the Hotel Booking Partner or its relevant booking/payment partners. Moments does not collect, hold or process your hotel payment as merchant of record.

Before confirming a hotel booking, you will be shown relevant price, availability, room type, taxes, fees, cancellation policy and provider terms.

Hotel prices and availability may be checked live and may change until the booking is completed and confirmed by the relevant Hotel Booking Partner, accommodation provider or supplier.

Your hotel booking is confirmed only after the required payment is completed and the relevant Hotel Booking Partner, accommodation provider or supplier confirms the booking.

Any hotel voucher, reservation confirmation, cancellation or refund process may be issued or handled by the Hotel Booking Partner, its booking/payment partners, the accommodation provider or the relevant supplier. A Moments trip summary is not a hotel booking voucher unless expressly stated.

Activities are optional local services or experiences that may be displayed in connection with a collection, trip, retreat or destination.

Activities may include guided tours, local guides, private guides, transfers, pickup services, boat trips, workshops, tastings, outdoor experiences, cultural visits, entrance arrangements, equipment rental, meals, destination services or other local experiences.

Activities are provided by independent local Providers, DMCs, guides or activity partners unless expressly stated otherwise.

Activity payments are made directly to the relevant Provider or through the Provider’s payment link. Moments does not collect, hold or process activity payments.

Activities are not included in the hotel price unless clearly stated. Most activities are optional and must be selected, booked and paid for separately.

If you do not select, pay for and receive confirmation for an activity when required, you are not booked for that activity and you may not participate in it.

Spots are curator notes and editorial recommendations around a trip. They may include places to eat, swim, walk, shop, photograph, visit or understand the rhythm of a destination.

Spots are not automatically bookable services. Unless clearly stated, spots do not include a reservation, guide, transfer, ticket, entrance, meal or participation right.

Curator notes are personal recommendations and opinions. They are not legal, medical, safety, immigration, insurance, financial or professional advice.

Stays and activities are separate services.

Your hotel booking is processed through the Hotel Booking Partner. Your activity booking, if any, is processed directly through the relevant Activity Provider, DMC, guide, activity partner or payment link.

Moments does not collect traveler payments for hotels or activities.

The fact that a hotel, activity, spot, note or route appears in the same collection, trip lobby or itinerary does not mean that they are sold as one package, one contract, one total price or one all-inclusive product.

Each service may have its own Provider, contract, payment flow, confirmation process, cancellation policy and refund rules.

Unless expressly stated otherwise, Moments does not sell package tours, package holidays, all-inclusive trips or bundled travel products.

Collections, trip lobbies and itineraries are designed to help you discover and organize separate services. They do not automatically combine hotel stays, activities, transfers, meals or local services into one package product.

Activities are optional unless a specific hosted retreat or provider page clearly states that a particular activity is included.

No single total package price is charged by Moments for hotel stays and activities together.

No activity is automatically included in a hotel booking unless the relevant product page clearly states that it is included by the relevant Provider.

Depending on your location, applicable law, the services selected and the order in which you book them, booking more than one travel service for the same trip may constitute a linked travel arrangement or similar separate-services arrangement.

Moments is designed so that stays and activities are presented as separate services supplied by independent Providers, with separate contracts, separate prices, separate payment flows and separate confirmation terms unless expressly stated otherwise.

Where applicable law requires a specific pre-contractual information notice for linked travel arrangements or similar arrangements, Moments will provide such notice before the relevant booking step.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer or travel laws.

A trip lobby is a shared planning space.

A trip lobby allows users to view a collection, invite friends, organize trip context and access separate booking options. A trip lobby does not automatically create a group booking, package tour, shared payment obligation or guaranteed availability.

Each traveler may complete their own booking and payment separately. Room type, guest details, payment method, cancellation rules and provider terms may differ for each traveler.

Inviting friends to a trip lobby does not reserve rooms, activities, capacity or prices unless the relevant booking is completed and confirmed by the relevant Provider.

A trip lobby keeps the plan together. It does not merge separate travel services into one legal package or one shared payment obligation.

Hosted retreats are fixed-date journeys shaped by a curator, host or Provider.

Each hosted retreat page should clearly explain what is included and what is not included. Accommodation, meals, programming, transfers and activities are included only if expressly listed as included on the retreat page.

Some hosted retreats may require application or approval before booking. Approval does not guarantee participation unless the required booking and payment steps are completed within the stated time window.

A hosted retreat may involve separate Providers for accommodation, activities, transfers, meals or other services. Their respective terms may apply.

Unless expressly stated otherwise, Moments does not operate the retreat services and does not collect traveler payments for the underlying travel services.

Prices shown on the Platform may vary by date, room type, season, availability, capacity, provider conditions, exchange rates, taxes and fees.

Moments aims to display useful and accurate information, but prices and availability are not guaranteed until the relevant booking is completed and confirmed by the relevant Provider or booking/payment partner.

If a price, availability or description error occurs before confirmation, the booking may not be completed at the incorrect price.

Cancellation, change and refund rights depend on the specific service, Provider, rate, date, activity, payment link and policy shown before booking.

Hotel cancellation rules may differ from activity cancellation rules.

Some bookings may be refundable, partially refundable or non-refundable. Some activities may depend on weather, minimum group size, safety conditions, provider availability or local operational requirements.

Moments may help communicate with Providers when possible, but refund, change and cancellation decisions are governed by the relevant Provider’s terms unless Moments is expressly the contracting provider for a specific service.

Because hotel and activity payments are handled separately, refunds may also be handled separately by the relevant Provider or payment partner.

You are responsible for checking all booking details before confirmation, including destination, dates, guest names, room type, activity details, meeting point, passport or visa needs, health requirements, mobility requirements, cancellation policy and local rules.

You are responsible for ensuring that you and your travel companions are fit to travel and fit to participate in any selected activity.

You must provide accurate information during booking. Moments and Providers are not responsible for problems caused by incorrect names, dates, contact details, guest information or travel documents supplied by you.

Travel involves risks.

Activities may involve physical movement, outdoor conditions, water, boats, vehicles, animals, heights, weather exposure, equipment or other risks. You should read the activity details carefully and decide whether the activity is suitable for you and your travel companions.

Local conditions, weather, safety rules, Provider instructions and legal requirements must be followed. Providers may refuse participation if safety requirements are not met.

Moments does not inspect or control every local condition, route, activity site, vehicle, vessel, guide, venue or piece of equipment used by independent Providers.

Curators are independent individuals or entities who create or contribute travel content, collections, notes, spots, retreat concepts or recommendations.

Curators are not employees, agents, travel agents or legal representatives of Moments unless expressly agreed in writing.

Curator recommendations reflect their personal point of view. Moments may review content before publication, but Moments does not guarantee that every recommendation will fit every traveler’s preference, budget, ability or expectation.

Moments may restrict, suspend or disable paid booking flows for users located in Türkiye, users resident in Türkiye, users using Türkiye-issued payment methods, users using Türkiye phone numbers, or users accessing the Platform from Türkiye, depending on legal, regulatory, operational or provider requirements.

Where such restrictions apply, users may still be able to browse content, collections or editorial information, but may not be able to complete hotel or activity bookings through or in connection with the Platform.

Moments may also restrict access to certain destinations, services or Providers where required for compliance, licensing, consumer protection, sanctions, provider or operational reasons.

Moments may request additional information or block a booking attempt if it reasonably believes that a booking may breach these restrictions.

When you use the Moments mobile application, you are also subject to the applicable app store rules.

Apple App Store and Google Play are not responsible for the travel services displayed, linked or booked through Moments. They are not parties to your booking contracts with Providers.

If you download the app through an app store, the app store provider may process certain technical, account or payment-related information according to its own terms and privacy rules.

Moments is currently operated as a pre-incorporation digital platform project.

Once the operating company is incorporated outside Türkiye, these Terms may be transferred or assigned to that company. The updated legal company name, registered address, company number and contact details will be published on the Platform.

By continuing to use the Platform after such update, you acknowledge that the incorporated operating company will become the Platform operator from the effective date of the updated Terms.

This update will not change the core payment structure: Moments does not collect traveler payments for hotel stays or activities unless expressly stated in a future version of the Terms.

To the maximum extent permitted by law, Moments is not responsible for the acts, omissions, delays, cancellations, service failures, accidents, injuries, losses or damages caused by independent Providers, hotels, the Hotel Booking Partner, accommodation suppliers, booking/payment partners, Activity Providers, guides, DMCs, transportation providers, payment providers or other third parties.

Moments remains responsible only for obligations that applicable law does not allow us to exclude or limit, and for the Platform services that Moments directly provides.

Nothing in these Terms excludes or limits mandatory consumer rights that cannot legally be excluded.

If you are a consumer, you may have rights under the laws of your country of residence, the country where the service is supplied or other applicable consumer protection laws.

These Terms are governed by the laws of [JURISDICTION TO BE CONFIRMED AFTER INCORPORATION], unless mandatory consumer protection rules in your country of residence provide otherwise.

Until the operating company is incorporated, the applicable governing law and dispute forum may depend on the user’s location, the Provider’s location, the payment partner’s terms and mandatory consumer protection rules.

Disputes relating to hotel bookings may be subject to the Hotel Booking Partner, its booking/payment partners or the relevant accommodation Provider’s terms. Disputes relating to activities may be subject to the relevant Activity Provider’s terms.
