Provider / DMC Terms

These Provider Terms apply to local providers, DMCs, guides, activity partners, transfer providers, experience operators or other third-party service providers whose services are displayed, linked or offered in connection with Moments.
Provider status
The Provider is an independent contractor and is solely responsible for the service it provides.
The Provider is not an employee, agent or legal representative of Moments unless expressly agreed in writing.
Service delivery
The Provider is responsible for delivering the activity, tour, transfer, guide service, workshop, experience, meal, entrance arrangement, equipment rental or other local service described on the activity page or provider page.
Payment
Activity payments are made directly to the Provider or through the Provider’s payment link or payment service provider.
Moments does not collect, hold or process activity payments unless expressly agreed otherwise in writing.
Licenses and compliance
The Provider must hold all licenses, permits, registrations, insurance, tax registrations and authorizations required under applicable law.
The Provider is responsible for guide qualifications, vehicle standards, equipment standards, safety rules, local compliance, taxes, invoices, receipts and consumer obligations related to the services it provides.
Accuracy of information
The Provider must provide accurate, complete and up-to-date information about:
- what is included;
- what is not included;
- guide availability;
- pickup or transfer inclusion;
- meeting point;
- timing and duration;
- capacity;
- physical requirements;
- age restrictions;
- equipment;
- meals;
- entrance fees;
- taxes or local fees;
- cancellation and refund policy;
- weather or minimum participation conditions;
- safety requirements;
- emergency contact details.
Changes and cancellations
The Provider must inform Moments and affected travelers as soon as possible if an activity must be cancelled, rescheduled or materially changed.
Changes may be made only for valid operational, safety, legal, weather or provider reasons, or with traveler consent where required.
Safety
The Provider is responsible for participant safety, risk assessment, operational safety, qualified staff, suitable equipment, emergency procedures and compliance with local laws.
Traveler disputes
The Provider is responsible for resolving disputes, complaints, refunds, chargebacks or service failures related to the Provider’s service, except where Moments has expressly assumed responsibility in writing.
Suspension
Moments may remove, pause or suspend a Provider or activity if information is inaccurate, unsafe, misleading, unlicensed, non-compliant or inconsistent with Moments standards.
